Any references made in these By-Laws or references to corresponding FIBA Regulations that are made in the male gender, are done for the sake of expediency and consistency and is not intended for, nor permits, such references to be invalid for the female gender.

All FIBA Regulations adopted by Basketball Australia shall apply in their entirety except where an inconsistency is described, suggested or implied by these By-Laws including other written directions from the Eastern Hills Basketball Association, made from time to time, in which case the latter shall prevail.

ADMINISTRATION

Article 1.   General

(a)        Throughout these By-Laws the term Management shall refer to the Eastern Hills Basketball Association Committee, its members or delegates, representatives, or any other person that is appropriately provided with authority to act on behalf of the Eastern Hills Basketball Association, or its Committee, including any sub-committees that may be established from time to time.

(b)        Any matters not covered by the Constitution, Rules or By-Laws shall be dealt with and administered by Management on an ongoing basis, or may be dealt with by the Referee on an immediate once-off basis if required.

(c)        Authority for any matters included in these By-Laws rests with the Referee.

(d)        Any appeal against the decisions of Management must firstly be made directly to Management and then if not satisfied with the outcome, the aggrieved club, body or person, may lodge their appeal to the SA Country Basketball Council, or any subsequent ruling body.

Article 2.   Life Membership

(a)        There should be a minimum of ten (10) years’ involvement in the Association: ‘club’ involvement does not apply in this instance. Qualifying activities may include Office Bearer, Committee Member, Honorary Position, Coach or Manager of an Association Team(s), or Referee.

(b)        The award of Life Membership should be in recognition of exceptional and outstanding voluntary service to basketball at an Association level.

(c)        Nominations of candidates are able to be received from a member club, a Life Member or any member of Management .

(d)        Management shall consider those nominations and make a recommendation to the Committee.

(e)        The Committee shall vote upon nominations and where approved by an absolute majority, the nominee shall be awarded Life Membership.

(f)         The award including Certificate, Badge of Office and Life Member Jacket shall be made at the next EHBA official function.

FOR EXAMPLE: Grand Final Day, Presentation Function, Dinner or Special Event.

Article 3.   Clubs

(a)        Management will allow teams to compete as part of a club.

(b)        To be able to nominate, all teams must be part of a club, or have an affiliate association with a club or the Association, that has been recognised by Management.

(c)        All clubs shall provide to the Administrator details of their current office bearers within fourteen days of their election and the postal address for the serving of notices.

(d)        Individual teams may be required by Management to nominate a ‘responsible person’ including their name, position held, mailing address and contact numbers.

(e)        Management shall not direct how clubs may or should be managed.

Article 4.   Officials

(a)        Conduct of all officials shall be overseen by Management.

(b)        Umpires–in–Charge may be appointed annually by Management.

(c)        Umpires–in–Charge shall be responsible for the conduct of the competition for the allocated games and shall liaise with Management in the appointment of referees to all games.

(d)        Officials must adequately notify the Management with sufficient notice of their inability to attend games as rostered.

PENALTY: the official will be deducted two game payments for each game missed. In addition, if the Official has been nominated by a team in a senior competition as an Umpire, the nominating team will be deducted three premiership points for each game missed.

(e)        All officials shall familiarise themselves with the FIBA Regulations adopted by Basketball Australia, Association By-Laws and Reporting Procedures in order to efficiently and fairly perform their duties.

(f)         Any complaint concerning the conduct of officials shall be made in accordance with these By-Laws.

 

Article 5.   Programs

(a)        All games are to be played as listed in the Official Program including finals.

(b)        Games may only be changed with the full knowledge, support and consent of Management, or its delegate, and both or all of the teams involved.

(c)        This shall only occur where it places no team – either those directly involved in the game or otherwise within the same grade – at a distinct advantage or disadvantage by doing so.

GAME CONDITIONS

Article 6.   Playing Conditions

(a)        The game must commence when three (3) or more players in each team are in attendance.

(b)        Once both teams have at least (4) four players on the court within ten (10) minutes of the start of the game, the game will be played in its entirety.

(c)        The coach (or the team captain if there is no coach named) shall be responsible for the actions of their players, spectators and supporters.

(d)        Those involved in unruly or unsportsmanlike behaviour shall be controlled as follows:

i.           By the coach of their team; and if that fails then

ii.          By the match referee who shall ask them to leave the stadium; and if that fails then

iii.         The referee will abandon the game, award a forfeit result against the offending team and notify Management of the circumstances.

iv.        The referee (or a person appointed by the referee) may need to call the Police if that person believes the matter is out of control or if property or people are at risk

FOR EXAMPLE: Cars in car park, stadium property, threat to personal safety.

(e)        Outside of game times, no player shall hang or pull on the ring, apparatus or net, or through any type of shot attempt cause the ring to move from its horizontal position.

PENALTY: the player shall receive a personal technical foul; have 2 points awarded to the opposing team and that player’s team shall receive a Team Warning. Any subsequent event by any member of that team having been warned shall see that next offending player disqualified from the game.

(f)         Coaches- During the course of game coaches will remain seated in the team bench area at all times except under the following conditions:

                   i.        Coaches may stand to approach the bench to call time-outs and may stand during time-outs to address players.

                  ii.        Coaches may stand within their area of the bench to deliver instructions to players on court and bench players, but must resume seat immediately once finished.

In addition coaches may not interact in any way with referees during the course of a game except during time-outs and then in a respectful manner.

Coaches who fail to respond to a warning regarding this rule will receive a bench technical foul. Any subsequent breach will lead to disqualification from the game.

(g)        Outside of game times, no other person shall hang or pull on the ring, apparatus or net, or through any type of shot attempt cause the ring to move from its horizontal position.

PENALTY: that person shall be asked to leave the stadium and if that fails, the matter shall be reported to Management and the match referee (or a person appointed by the referee) may need to call the Police if that person believes the matter is out of control or if property or people are at risk.

(h)        Any damage is to be paid for by the person concerned.

(i)         In minor round games, the score shall stand at the end of the second half, which may result in a draw.

Article 7.   Scorers and Scoresheets

(a)        The scoresheet should be completed prior to the commencement of the game. Players may be entered on the scoresheet no later than the end of the first half.

PENALTY: Players who have not been entered on the scoresheet by this time are not permitted to play.

PENALTY: 1 point per minute or part thereof until the scoresheet is completed.

(b)        The team captain shall be indicated prior to the commencement of the game.

(c)        All teams must provide a competent score bench official, with a minimum age of 14 years old, prior to the team taking the court.

PENALTY: 1 point per minute or part thereof until a maximum of 5 points per half.

 

Article 8.   Forfeits

(a)        There shall be two types of forfeits:

i.           A notified forfeit shall occur where a team notifies the Administrator at least twenty four hours prior to the programmed start time of the game.

ii.          A non-notified forfeit occurs when either notice has failed to have been given, or it is given less than 24 hours prior to the programmed start time of the game.

(b)        In the event of a notified forfeit:

i.           players from the non-forfeiting team will be able to claim the forfeited game as a game played if that player is named on the scoresheet in the preceding or following game for that team.

ii.          players from the forfeiting team will not be able to claim the forfeited game as a game played.

iii.         The forfeiting team shall be fined an amount as set by Management.

(c)        Teams must have at least four (4) players on court within ten (10) minutes of the start of the game.

PENALTY: the result of the game is awarded to the opposing team by a non-notified forfeit.

(d)        In the event of a non-notified forfeit:

i.           players from both teams who attend shall receive a refund of their game fee.

ii.          the score sheet shall stand as the record for player qualification and the match referee shall mark off those players not in attendance at the time the forfeit is declared.

iii.         The forfeiting team shall be fined an amount as set by Management.

(e)        All forfeits will be recorded with a score of 20 – nil.

(f)         Where a team forfeits a finals game, that team is automatically disqualified from any further finals in that season and forfeit fines shall be double the corresponding minor round amount.

(g)        All fines must be paid within fourteen (14) days of the date of issue of the fine notice.

PENALTY: no premiership points will be awarded from the date of the forfeit until the fine is paid.           Additional penalties may be imposed at the Committee’s discretion.

(h)        An appeal may be lodged against any fine imposed, provided that:

i.           The fine has been paid in accordance with Article 8 (g); and

ii.          The written appeal notice is lodged with the Administrator within fourteen (14) days of the date of issue of the fine notice with the matter to be heard by Management.

iii.         A club who withdraws a team from the current competition will e charged a default bond of $100, payable by next season.

Article 9.   Timing Conditions

(a)        For minor round games, the game will be played over two (2) twenty (20) minute halves with a two-three (2-3) minute half time break.

(b)        The clock shall be started at the scheduled starting time regardless of the readiness of either team.

(c)        The clock shall run continuously and not stop except:

i.           The clock shall stop in all other grades in the final two (2) minutes of the second half on all whistles, and after each basket UNLESS (1) one team is ahead by twenty (20) points or more with exactly two (2) minutes remaining;

ii.          Where one (1) team is ahead by twenty (20) points or more with exactly two (2) minutes remaining the clock shall only stop for time-outs;

(d)        The clock shall not stop at all in Under 10 Grades;

(e)        No time-outs or substitutions will be permitted to be taken or to run into the final one (1) minute of the first half UNLESS for an injured player substitution, where the referee has instructed the clock to stop or otherwise allows such a substitution in order to prevent one side from being at an unfair disadvantage.

(f)         For timing regulations concerning finals, refer to Article 11.

Article 10. Premiership Points

Premiership points shall be awarded as follows:

Win                       three (3) points

Draw                     two (2) points

Loss                     one (1) point

Loss by forfeit      zero (0) points

Bye                       two (2) points

 

Article 11. Finals

(a)        At the end of the minor round the top four (4) finishing teams shall qualify for the finals.

(b)        In the event of more than one team ending with the same number of premiership points, final standings shall be based on the points percentage of the teams ending on the same number of premiership points. In the event that more than one team end on equal premiership points and points percentage, see FIBA Game Procedures D: Classification of Teams.

(c)        The first week shall be two (2) semi finals where the first semi-final shall be 1st v 2nd; and the second semi-final shall be 3rd v 4th. The second week shall be a preliminary final between the loser of the first semi final and the winner of the second semi final. The winner of the preliminary final shall play the winner of the first semi final in the grand final.

(d)        All teams must provide a competent score bench official who is not a player or coach, prior to the team taking the court.

PENALTY: game shall not commence until a scorer can be found.

(e)        All senior league finals shall be played in four (4) ten (10) minute quarters with two (2) minutes between each quarter and any extra periods.

(f)         In senior league finals one (1) time-out per team shall be permitted in each of the first three (3) quarters and any extra periods, and two (2) time-outs shall be permitted in the final quarter. Timeouts may not be carried over between quarters or extra periods.

(g)        In all senior league semi finals and preliminary finals the clock shall stop for all time-outs; injuries where instructed by the referee; and all whistles in the final one (1) minute, in the first and third quarters. Full championship conditions shall apply for the second and fourth quarters and any extra periods.

(h)        In all senior league grand finals, full championship conditions shall apply.

(i)         In all other grades, the clock shall stop for all time-outs, fifth foul, disqualification and injury substitutions throughout the game. Full championship conditions apply in the final one (1) minute of the first half and the final two (2) minutes of the second half.

PLAYER CONDITIONS

Article 12. General Conditions

(a)        Players may play up to two games in any calendar week (Sunday to Saturday), inclusive of senior and junior games

FOR EXAMPLE: two senior games, two junior games or one senior and one junior game per week.

(b)        Players playing two senior games per week may only play in the one (1) grade below their highest usual grade.

FOR EXAMPLE: A usual A grade player, may only play in A and B grade.

(c)        Where a club fields more than one (1) team in any grade, that club shall have up to and including the third game of each team to finalise the composition of their players for that season. From the fourth game for that team in that season, players may not switch teams within that grade.

Article 13. Registration

All players must be registered before playing.

PENALTY: no premiership points will be awarded for any games played by an unregistered player.

 

Article 14. Qualifications

(a)        To qualify for finals, a player must play a minimum of the required number of games in that season after registering.

(b)        The required number of games shall be one third of programmed games, excluding byes, rounded up to the next full number or five (5) games whichever is greater. In special circumstances, players may apply management for a special permit

FOR EXAMPLE: In a 16 programmed game season, a player must play in 6 games to qualify for finals.

(c)        During the finals, players from a lower grade or lower age group may play in a higher grade or age group but only to ensure that there is a maximum of six (6) players in that team, provided that:

i.           the player playing in a higher grade or age group must have qualified for finals participation in a lower grade or age group, in accordance with (b) above.

ii.          junior players are not permitted to fill in for a senior team unless qualified in a senior grade.

(d)        To qualify to represent the Association at country carnivals or in any representative teams, a player must have qualified by the nomination date in the current season, unless a specific permit has been issued.

Article 15. Special Permits

(a)        A special permit to play in representative games may only be granted where:

i.           insufficient “qualified” players have nominated to play; and

ii.          a player has been unable to qualify as per Article 15 (d) above; and

iii.         the player is considered by Management as an Association player based upon past records and is currently playing but has not as yet qualified.

(b)        A permit may be granted by a player’s registered club or team where the player wishes to play a second game per week for another club, provided that the registered club has no team in that particular grade.

(c)        A special permit may be granted by the Management in specific circumstances.

Article 16. Player Grading

(a)        Clubs shall nominate their teams on the approved forms within the times prescribed for each season.

(b)        Management has the power to alter the grade of any team or any player either prior to the season commencing or at any time during the season.

(c)        An ABA player must not play in any grade below the highest run by the Association.

(d)        A team cannot have more than two (2) players who have played in the ABA at any stage in either the preceding or current season unless all teams in that grade already have two (2) players.

(e)        Management may accept or reject any nomination for either team(s) or player(s).

(f)         Management may fill teams or allocate players to teams as necessary.

Article 17. Uniforms

(a)        Basketball attire must be worn at all times.

i.           All players must wear the correct uniform for that team.

ii.          The colours of shirts, shorts and numbers are to be uniform throughout the team.

iii.         All players must have a legal number with no duplications.

iv.        Legal numbers are 4 to 15; 20 to 25; 30 to 35; 40 to 45; or 50 to 55, inclusively.

v.         The length of shorts may vary, however the length must not cover the knee.

PENALTY: The player is awarded a technical foul and the opposition is awarded two (2) points per offending player

EXCEPTION: All teams have their first three (3) programmed games in a season in which to obtain the correct uniform for all players.

(b)        Management may grant an extension of time for correct uniform to be obtained if the Club makes a written application prior to the expiration of the three game period above.

(c)        Pockets in uniforms are not permitted at any time of the season.

PENALTY: The player is not permitted to play in the game, or continue to play.

(d)        Other uniform requirements established by FIBA Regulations apply at any time of the season.

FOR EXAMPLE: visible shirts or shorts under the uniform, jewellery, medical casts, multi-coloured or striped sweatbands, wristbands or headbands.

PENALTY: The player is not permitted to play in the game, or continue to play.

 

Article 18. Specific Junior Playing Conditions

Unless described, suggested or implied below, all general By-Laws and FIBA Regulations still apply to junior games.

(a)        Junior By-Laws apply to all games up to and including under 18 grades.

(b)        Where a Club has a team in more than one (1) Division in any one grade, players nominated in a lower division may also play in a higher division as their second game per week.

(c)        Players nominated or who have qualified for finals in a higher division may not play in a lower division, in the same age group.

(d)        Qualifications for Junior grades is determined by the player’s age on 31 December of the year of the last programmed game, including finals.

FOR EXAMPLE: To play in the under 16 grade for a season that ends in April 2004, all players must be age 15 years of age or less on 31 December 2004.

(e)        In all under 10, under 12 and under 14 grade games, all players must play man-to-man defence in accordance with the Basketball Australia directive.

(f)         In all under 10, under 12, under 14 grade games, when a team is leading by twenty (20) points or more, or by ten (10) points or more in under 10 grades, all five (5) players from the leading team must be behind their three point line before any player may leave their three point area and play man to man defence.

PENALTY: A violation is called if the attacking team is placed at a disadvantage. Excessive or continued non-adherence by the defending team may result in a bench technical foul shall be charged against the coach.

(g)        In finals, Article 19 (f) shall not apply.

(h)        In under 10 grades the named coach for a team may enter the court during play to assist in the positioning of players, however the coach may not interfere with play.

PENALTY: A bench technical foul shall be charged against the coach.

(i)         In under 10 grades, no Premiership Points or Most Valuable Player votes are recorded however, game scores will be recorded.

DISCIPLINARY

Article 19. Reports

(a)        Reporting of players, coaches or spectators may be made by any official rostered to that game or Management present at that game.

(b)        SA Country Basketball Reporting procedures shall be followed.

(c)        In addition to this in senior competition only Umpires may choose to use the “Warning and Technical foul option” of reporting. This is to be used when problems arise which do not warrant a report being made to the Tribunal. This could include continued back chatting of umpires, use of obscenities, or other matters which detract from the game. This is to operate in the following way:

                   i.        If only a warning is deemed necessary the umpires are to stop play. The teams coach or captain may first be called over, then the player if involved. The coach or player is then to be warned regarding their behaviour.

                  ii.        The scorer is the record this on the score sheet with a “W” with the players number or name.

                 iii.        If a second player from the same team is warned then the whole team is to be warned.

                iv.        If the infraction is seen as being significant the warning may be accompanied with a technical foul.

                 v.        If the player or coach subsequently is seen to infringe then that person is given a technical foul.

                vi.        Once the player has been given two technical fouls they are asked to leave the game and stadium.

               vii.        At the end of the game the umpire is to highlight to the office the player or coach who has been ejected. This is then to be forwarded to the administrator. The administrator then forwards this information to the club involved.

(d)        In senior completion if a player or coach is ejected from the stadium for any reason then:

                   i.        If it is the person’s first ejection for the season then the person is automatically suspended for the next game in the grade they were involved in at the time of being ejected.

                  ii.        If it is the person’s second ejection in the same season then the individual is immediately suspended for another game in the grade they had been involved in. Also the person is not able to participate in further games of any grade until they have volunteered to umpire a round match themselves under the supervision of a senior umpire. If during finals the person involved may undertake written agreement to umpire the required round match the following season. However they are not to play in the subsequent season until this has occurred.

                 iii.        Any person ejected three times from the stadium in any one season will be suspended for the season, including finals. Prior to re entering the competition they must demonstrate they have attended anger management counselling, which they will be responsible to organise and pay for.

Article 20. Tribunals

(a)        The Tribunal Chairperson shall convene the tribunal in a timely manner to hear the report and shall conduct the tribunal in accordance with the Constitution.

(b)        Any player, coach or spectator may appeal against the decision of the tribunal and in doing so must follow the procedures as set out by SA Country.

Article 21. Complaints

a)     Complaints may be lodged by, or on behalf of, individuals, affiliated clubs or bodies, Officials or Management.

b)    All complaints should be lodged in writing to Management.

c)     The Administrator shall enquire of the affiliated clubs or body to determine that indeed the complaint so lodged is made on behalf of that affiliated clubs of body.

d)    The Administrator and Management shall refer to the Policy and Procedure Manuel and follow the relevant Policy and Procedure to appropriately respond to the concerns raised.

e)     Management reserve the right to call all parties to the complaint to a hearing or may waive the right to hold a hearing at their absolute discretion.

f)     Management may choose to request parties involve in the complaint to undertake an educational requirement within a reasonable time frame.

g)    Management may choose to penalise or suspend any party involved in the complaint, including teams or clubs.

h)     Management may choose at anytime to refer the complaint to the tribunal.

i)      Management shall notify in writing the parties to the complaint of their decision as soon as possible.
